Jharkhand Regional Development Authority Act, 2006

Section 1

Short Title, Extent & Commencement :- (i) This Act may be called " The Jharkhand Regional Development Authority (Amendment) Act-2006" (ii) It shall extend to the whole of the State of Jharkhand. (iii) It shall come into force at once.

Section 2

Amendment Of Section-30 Of Chapter- Vi Of Jharkhand Regional Development Authority Act-1981 :- In this Section of Jharkhand Regional Development AuthorityAct1981, the following proviso shall be inserted immediately after the first sentence ending with " may be notified from time to time" Provided that the State Government may by notification in the official Gazette direct that any or all provisions of this chapter shall be exercised by such officer or local authority as may be mentioned therein in such cases and subject to such conditions, if any, as may be specified therein and accordingly the power of the authority will cease to such extent.

Section 3

Amendment Of Section-53 Of The Jharkhand Regional Development Authority Act,1981 (Adopted) :- After Section-53 of the Jharkhand Regional Development Authority Act1981 after the existing provision the following two proviso shall b e inserted, namely Provided that the State Government may direct such agency that no such certificate will be compulsorily required for this purpose. Provided further that a mere water connection will not give any immunity to such occupant of a building from application of any other provision of this act.

Section 4

Amendment Of Section-65 (2) Of Jharkhand Regional Development Authority Act-1981 (Adopted) :- I n this Section of Jharkhand Regional Development Authority Act1 9 8 1 the following shall be inserted after the word, "general policy":- "and on matters in respect of chapter-VI for giving effect to the subjects pertaining to urban local bodies as provided in artical-243(W).

Section 5

Amendment Of Section-75 Of Jharkhand Regional Development Authority Act-1981 :- In this Section of Jharkhand Regional Development Authority Act1981 immediately after the second word "authority" the following shall be inserted- "or the State Government".

Section 6

Repeal And Saving :- ( i ) Repeal:-Jharkhand Regional Development Authority Act (Amendment) ordinance-2006 (Jharkhand ordinance02, 2006) is hereby repealed. (ii) Saving -Notwithstanding such repeal, any thing done or any action taken in the exercise of power conferred by or under the said ordinance shall be deemed to have been done or taken in exercise of powers conferred by or under this act, as if, this act were enforce on the day on which such thing was done or action taken.
