The Collector shall after making such inquiry as he may deem fit, decide which claims notifies or admitted under section 38 are to be allows in whole or in part, an which are to be disallowed, and, on his decision being confirmed by the Court, shall give written notice of the same to the claimants:

Provide that nothing herein contained shall be construe as precluding any claimant from continuing or instituting proceedings in any civil court in respect of any claim whether such claim be allow or disallow by the Court in whole or in part.
